LAWAHA TERMS OF SERVICE

1. Acceptance of Terms
By booking, attending, or participating in any classes, programs, events, or services offered by Lawaha ("the Studio," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services
Lawaha provides yoga classes, breathwork sessions, ice bath experiences, mobility training, wellness events, and related wellness services at our facility in Benaulim, Goa. All services are provided in-person at our studio location.
3. Health and Medical Acknowledgment
3.1 Medical Clearance
You confirm that you are physically and mentally fit to participate in yoga, breathwork, ice bath sessions, and other wellness activities.
You are responsible for consulting with a physician before participating if you have any medical conditions, injuries, or health concerns.
You must disclose any health conditions, injuries, or limitations to our instructors before participating.
3.2 Contraindications
Participation in ice baths and certain breathwork techniques may be contraindicated if you have:
Cardiovascular conditions
High or low blood pressure
Pregnancy
Recent surgery or serious injury
Respiratory conditions
Epilepsy or seizure disorders
You assume full responsibility for determining your fitness to participate.
4. Assumption of Risk and Liability Waiver
4.1 Inherent Risks
You acknowledge that yoga, breathwork, ice baths, and physical activities involve inherent risks including, but not limited to:
Muscle strains or sprains
Joint injuries
Cardiovascular stress
Slips, falls, or collisions
Aggravation of pre-existing conditions
4.2 Waiver of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, WAIVE, AND DISCHARGE LAWAHA, ITS INSTRUCTORS, STAFF, OWNERS, AND AFFILIATES FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES, OR DAMAGES ARISING FROM YOUR PARTICIPATION IN OUR SERVICES, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE.
You participate in all activities entirely at your own risk.
5. Bookings and Payments
5.1 Payment Methods
Payments are processed securely through Razorpay and other approved payment gateways.
We accept credit cards, debit cards, UPI, net banking, and other payment methods supported by Razorpay.
All prices are listed in Indian Rupees (INR).
5.2 Class Packages and Validity
Single class drop-ins are valid for the date of purchase only.
Class packages (if offered) are valid for the period specified at the time of purchase.
Unused classes in packages expire after the validity period and cannot be extended or refunded.
5.3 Payment Confirmation
Bookings are confirmed only upon successful payment verification.
You will receive a confirmation via email or WhatsApp upon successful booking.
6. Cancellation and Refund Policy
6.1 Client Cancellations
24-hour notice: Cancellations made at least 24 hours before the scheduled class are eligible for rescheduling or credit toward future classes.
Less than 24 hours: Cancellations made less than 24 hours before class or no-shows result in forfeiture of the class with no refund or credit.
6.2 Studio Cancellations
If Lawaha cancels a class, you will be offered a full refund or credit toward a future class.
We reserve the right to cancel classes due to insufficient enrollment, instructor illness, or unforeseen circumstances.
6.3 Refund Processing
Approved refunds will be processed within 7-10 business days to the original payment method.
Processing fees (if any) charged by payment gateways are non-refundable.
6.4 Weather and External Factors
Classes are held outdoors in our garden setting. In case of extreme weather (heavy rain, storms), classes may be rescheduled or moved to an alternative location. No refunds will be provided for weather-related changes.
7. Code of Conduct
7.1 Studio Etiquette
Arrive on time; late arrivals may not be admitted if they disrupt the class.
Maintain cleanliness and respect for the studio space and equipment.
Turn off or silence mobile phones during classes.
Refrain from wearing strong perfumes or colognes.
7.2 Respectful Behavior
Treat instructors, staff, and fellow participants with respect and courtesy.
Harassment, discrimination, or disruptive behavior will not be tolerated and may result in immediate termination of your membership without refund.
7.3 Photography and Recording
Photography or video recording during classes is prohibited without prior written consent from Lawaha.
Lawaha may take photos or videos for promotional purposes; by participating, you consent to such use unless you notify us in writing.
8. Personal Belongings
Lawaha is not responsible for lost, stolen, or damaged personal belongings. Please keep your valuables secure and do not bring unnecessary items to class.
9. Privacy and Data Protection
9.1 Information Collection
We collect minimal personal information necessary for bookings and communications, including:

Email address
Payment information (processed securely by Razorpay; we do not store payment details)
9.2 Use of Information
Your information is used solely for:
Class bookings and confirmations
Communication regarding classes, events, and updates
Payment processing
9.3 Data Security
We implement reasonable security measures to protect your personal information. We do not sell or share your information with third parties except as required for payment processing (Razorpay) or as required by law.
10. Intellectual Property
All content provided by Lawaha, including but not limited to class sequences, instructional materials, branding, website content, and promotional materials, is the intellectual property of Lawaha and protected by copyright law. You may not reproduce, distribute, or commercially use any content without prior written permission.
11. Account Termination
Lawaha reserves the right to terminate or suspend your access to our services at any time for:
Violation of these Terms
Inappropriate or disruptive behavior
Non-payment
Providing false information
Upon termination, you forfeit any unused classes or credits with no refund.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:
Lawaha's total liability for any claim arising from your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages.
We do not guarantee specific health outcomes or results from participation in our programs.
13. Indemnification
You agree to indemnify and hold harmless Lawaha, its instructors, staff, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
Your participation in our services
Your violation of these Terms
Your violation of any third-party rights
14. Modifications to Services and Terms
14.1 Service Changes
Lawaha reserves the right to modify, suspend, or discontinue any services, class schedules, or pricing at any time without prior notice.
14.2 Terms Updates
We may update these Terms periodically. Changes will be posted on our website and sent to registered clients via email. Continued use of our services after changes constitutes acceptance of the updated Terms.
15. Force Majeure
Lawaha is not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, power failures, or other force majeure events.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Goa, India.

BY BOOKING OR PARTICIPATING IN LAWAHA'S SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING THE ASSUMPTION OF RISK AND LIABILITY WAIVER.
